Learned Counsel for the Petitioner submits that this petition has been filed to condone the delay of 88 days in filing the Appeal in C.M.A.S.R.No.46131 of 2025.

2. The Respondent has filed the counter affidavit.

3. From the counter filed by the Respondent it is found that, the Petitioner herein as Respondent in the Claim Petition had deposited Rs.22,85,906/- as contribution, for the period from 01.11.2017 to 31.10.2022.

4. It is the contention of the Respondent in the counter of this Petition that the deposit of the amount gives an indication that the Petitioner herein does not intend to file any Appeal. Therefore, he seeks dismissal of this Petition.

5. The contentions raised in the counter shall be agitated in the main Appeal. For the present, the delay of 88 days is condoned.

6. Registry is directed to number the Appeal if it is otherwise in order and to print the name of the learned Counsel for the Respondent, and post the case before the appropriate Bench.
