C O M M ON O R D E R WP.No.11711 of 2022 has been filed to direct the respondents to dispose of the representation dated 19.01.2022 with regard to the amendment of the Rule of Tamil Nadu Engineering Sub Ordinate Services as per GO.Ms.No.1 dated 02.01.1990.

WP.No.11712 of 2022 has been filed to direct the respondents to promote the petitioner as Assistant Executive Engineer in Water Resource Department as per the Ruling of the Hon'ble Apex Court and High Court and as per the executive instructions and settled law observed by this Hon'ble Court in WP.No.3309 of 1991.

3. Heard the learned counsel on either side and perused the records.

4. In the counter filed by the respondents 1 and 2 in WP.No.11712 of 2022, it has been stated as follows in paragraph Nos. 31 to 33:- " 31. It is submitted that the petitioner in accordance to the above said promotion orders issued in G.O(D)No. 197, WR(A1) Dept, dated 01.09.2023 had assumed charge in the post of Assistant Executive Engineer on 29.09.2023 at Mining Monitoring Sub Division, Chidambaram.

32. It is submitted that the petitioner has prayed in his Writ petition to issue a Writ of Mandamus directing the respondents to promote the petitioner as Assistant Executive Engineer in Water Resources Department as per the Rulings of the Hon'ble Apex Court and High court and as per the Executive instructions and settled law observed by this Hon'ble court in W.P.No.3309 of 1991 and pass such further or orders as this Hon'ble court may deem fit in the light of facts and circumstances of the case, award cost and render justice.

It is submitted that the petitioner and similarly placed Assistant Engineers have already been temporarily promoted as Assistant Executive Engineers vide G.O.(D) No. 197, Water Resources (Al) Dept., dated 01.09.2023. Therefore the prayer of the petitioner to promote him to the post of Assistant Executive Engineer has already been materialized as stated supra and further the petitioner had assumed charge in the post of Assistant Executive Engineer on 29.09.2023 at Mining and Monitoring Sub Division, Chidambaram. It is submitted that in such circumstances, the prayer of the petitioner is rendered infructuous."

5. A perusal of the above referred paragraphs would show that the relief claimed by the petitioner has been granted. Accordingly, the writ petitions are disposed of in the light of the observations made in the above4/6

referred paragraphs. No costs. Consequently, connected miscellaneous petitions are closed.
