ORDER
The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents 2 and 3 to pay monthly pension to the petitioner as per the CCS Rules and the PF Act.
2. The case of the petitioner is that the petitioner joined the service of the 4th respondent in April, 1991, as Casual Labourer and subsequently, his services were regularized in the post of Helper with effect from 01.04.1995. Thereafter, he was promoted as Junior Assistant on 28.02.2009. From the date of regularization of service onwards, the 4th respondent has been deducting contribution from the petitioner towards contributory Provident Fund; however,
it is learnt that the said amount has not been remitted to the Provident Fund Department. The control and day-to-day management of the Corporation were also vested with the Government. Hence, the Government of Puducherry is bound to implement the GPF Scheme for the employees of the Corporation as well. The petitioner has only six months of service remaining prior to attaining superannuation and upon inquiry, it was stated that he is not entitled to receive pensionary and other benefits on the grounds that the GPF Scheme is not applicable to the Corporation.
3. It is the further case of the petitioner that the petitioner is suffering from heart disease and renal failure, for which he undergoes dialysis three days a week. Under these circumstances, the petitioner approached the authorities to sanction the GPF Scheme and pensionary benefits to him by submitting a representation dated 15.12.2025. Since no action has been taken by the respondents till date, the present Writ Petition is filed.
4. Heard the learned counsel for the petitioner, the learned Government Advocate (P) for respondent Nos.1 to 3 and the learned Additional Government Pleader (P) for respondent No.4.

Considering the facts and circumstances of the case and the submissions made by the learned counsel appearing for both sides, this Court directs the first respondent / Chief Secretary to Government of Puducherry, to consider the representation of the petitioner dated 15.12.2025 and pass appropriate orders, on merits and in accordance with law, within a period of two
(2) months from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
