Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 1st respondent herein to consider the petitioner's representation dated 09.04.2022, seeking release of Doc.No.P/127/2021 dated 25.08.2021 on the file of the second respondent herein, within the time stipulated by this Court.

ORDER

Mr.V.Manoharan, learned Additional Government Pleader takes notice for the respondents. With the consent of both sides, this writ petition is taken up for final disposal at the stage of admission itself.

The relief sought by the petitioner in the present writ petition is to direct the first respondent to consider his representation dated 09.04.2022, seeking release of Doc.No.P/127/2021 dated 25.08.2021 pending on the file of the second respondent, within a time frame to be stipulated by this Court.

3. The case of the petitioner is that he has purchased a

property situated in S.No.814 part, New S.No.897/32 of Singampatti Village from one Velusamy and Ammakannu, who executed a Sale Deed dated 25.08.2021 and presented the same for registration before the second respondent. The said Sale Deed was received and assigned as Document No.P/127/2021, however, was kept pending for want of valuation of house property mentioned in the document. Subsequently, after conducting a spot inspection, the second respondent / Sub Registrar, Vadamadurai, has also prepared a valuation report. While the petitioner was waiting for the return of his original document, he was informed that the then Sub-Registrar, Vadamadurai, who received his original document, was suspended from service due to administrative reasons.

Thereafter, when the petitioner approached the new Sub Registrar, Vadamadurai in person, for getting back his original document, he was informed that the sale deed dated 25.08.2021 will be cancelled and he has to present a new sale deed. Feeling aggrieved, he submitted a representation dated 09.04.2022 to the first respondent requesting to return the original sale deed dated 25.08.2021 after registration of the same by the second respondent. However, till date, no action was taken on the same. Therefore, this writ petition.

4. Heard the learned counsel on either side and perused the materials placed before this Court.

Considering the limited relief sought by the petitioner, this Court without going into the merits of the case, directs the first respondent to consider the petitioner's representation dated 09.04.2022 and pass appropriate orders on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner as well as any other interested parties, within a period of four weeks from the date of receipt of a copy of this order.

6. This writ petition is disposed of with the above direction. No costs.
