ORDER
This Criminal Original Petition has been filed seeking a direction to the learned Principal District and Sessions Judge cum Special Judge for SC/ST Cases, Tiruvannamalai to consider and pass order on the petitioners bail application in connection with the Crime No. 6/2026 on the file of 2nd respondent police on their surrender and pass orders on merits on the same day.
2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the respondents 1 and 2.

Considering the submissions made by the learned counsel on either side and upon perusal of the materials available on record, it is seen that the first accused was in a live-in relationship with de facto complainant/3rd respondent on the false promise that he would marry her. Subsequently, the accused No.1 avoided communication with the 3rd respondent and refused to marry her. When the 3rd respondent and her family members went to the house of the accused No.1, the petitioners/accused abused them by mentioning their caste name and also threatened with dire consequence.

In view of the specific bar under Section 18 of the Scheduled
Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also taking into consideration the possibility of misusing the pious intention of the Parliament against innocent persons, there shall be a direction to the jurisdictional Court, to consider the petitioners' bail application, preferably on the same day of their surrender, in connection with Crime No.6 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court within a period of fifteen days from the date of receipt of a copy of this order.
