ORDER

The petitioner had filed this Writ Petition to quash the impugned proceedings of the respondent in Na.Ka.No.147/Ni/Dharmapuri/2026 dated 05.03.2026 and consequently direct the respondent to grant permission to the petitioner to conduct hunger strike on behalf of the political party namely Tamil Manila Congress on 16.03.2026 or any other day in the month of March, 2026.

The contention of the learned counsel for the petitioner is that the petitioner is the District President of Tamil Manila Congress and he is working hard to bring good companies at SIPCOT, Dharmapuri for employment to District people. This being so, suddenly on 04.02.206, the District Collector had announced the newly constructed said Additional Bus stand as Main bus stand and stopped all mofussil buses to enter the town. Due to sudden change of bus stand, difficulties are being faced by the vendors and the general public. Hence, on 28.02.2026, the petitioner requested permission for lawful hunger strike to the Inspector of police. But the Inspector of Police vide impugned proceedings rejected the application of the petitioner.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that the strike was supposed to be held on 07.03.2026 and the

same has been rejected by the impugned Order dated 05.03.2026 and now the date has been lapsed and hence, this petition has become infructuous. His further contention is that due to forth coming general election, no protest can be permitted. Further, he would fairly submit that if any application is given by the petitioner immediately after election, the same will be considered as per law.

In view of the above submissions, the petitioner is directed to give a fresh representation to the respondent after general election seeking permission for protest and the respondent shall consider the same and pass appropriate Orders on the representation of the petitioner, if otherwise, it is not prohibited.
