O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379, 430 of IPC and r/w 21(5) of Mines and Minerals (Development and Regulations) Act 1957 in Crime No.1331 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. It is the case of the prosecution that the petitioner is alleged to have transported four units of sand illegally by using Lorry without any valid licence. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner. 2/5

4. The learned Additional Public Prosecutor appearing for the respondent submitted that the quantity of sand involved is four units. He further submitted that there there are seven previous cases pending against the petitioner. Hence, he opposed for the grant of anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
