IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED : 27.03.2025

CORAM

THE HONOURABLE MR.JUSTICE P.VELMURUGAN J. Raja @ Rajasekar ... Petitioner Vs.

T.Vidhya ... Respondent Criminal Miscellaneous Petition filed under Section 528 BNSS, 2023 to amend as M.C.No.31 of 2020 instead of M.C.No.20/2020 wherever it occurs in Crl.M.P.No.4798/2025 in Crl.R.C.Sr.No. 67355/2024 order dated 13.03.2025 and pending disposal of the present Crl.R.C.

For Petitioner : Mr.C.R.Gobinaath

O R D E R

It is stated that the petitioner-husband has filed a petition seeking to condone the delay of 50 days in filing the revision petition by wrongly quoting the case number in the maintenance case as M.C.No.20 of 2020 1/4

instead of M.C.No.31 of 2020, which is the actual maintenance case number. Since there is no specific provision to amend the order as per the provisions of the Code of Criminal Procedure, this criminal miscellaneous petition is dismissed. However, the petitioner is at liberty to file a fresh miscellaneous petition in the manner known to law. 27.03.2025 ms 2/4
