J] Captioned 'Criminal Miscellaneous Petition' [hereinafter 'Crl MP' for the sake of convenience and clarity] has been filed with 'condonation of delay' ['COD'] prayer. COD is qua 57 days in filing Criminal Appeal being Crl.A.SR.No.15567 of 2023 against the judgment dated 30.11.2022 in S.C.No.121 of 2019 on the file of Principal District and Sessions Court, Salem.
2. Mr.E.Raj Thilak, learned Additional Public Prosecutor accepts notice for the respondent and submits that no other appeal has been preferred by the petitioner.
3. Mr.RMD.Nazurullah, learned counsel on record for petitioner is before us.

4. Learned counsel, adverting to paragraph No.3 of the support affidavit submits that difficulty for the appellant's father in mobilizing funds to file the appeal has been cited as the reason.
5. Considering the facts and circumstances of the case and nature of the matter, we have no difficulty in accepting the reason qua COD prayer.
6. Captioned Crl MP ordered as prayed for. Delay condoned. There shall be no order as to costs.
