Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of Mandamus directing respondents 1 to 3 herein to evict respondent 4 and 5 from the place of encroachment in S. No.170/4 from Rantham ERI and Kalvai in Thellur Village and Post, Arani Taluk, Thiruvannamalai District.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The allegation of the petitioner of encroachment of public land in S.No.170/4 by private respondents 4 and 5 has been found to be incorrect as per the counter affidavit. S.No.170/4 is stated to be private land. The fourth respondent is stated to have dug a well in S.No.163/1, which is his patta land and there is no house constructed in either of the two survey numbers. In view of the aforesaid, the petition is dismissed. No costs.
