This Civil Miscellaneous Petition is filed to set aside the judgment, dated 04.04.2019, passed in S.A.No.560 of 2008 and restore the Second Appeal.

Second Appeal was dismissed for non-prosecution on 04.04.2019 and the petitioners have filed this petition within four days thereafter on 08.04.2019.

However, this petition is listed only now.

Heard the learned counsel for the parties.

Mr.S.R.Singaravelan, learned Senior Counsel, appearing for the respondents, has no serious objection for this petition being allowed.

Having been satisfied with the reasons stated in the affidavit filed in support of the petition, this Civil Miscellaneous Petition is allowed and the Second Appeal is restored.

Registry is directed to list the Second Appeal for hearing on 15.03.2024.
