CR.NO.40/2016 Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition dated 10.05.2017 made in Crl.M.P.No.6258 of 2017 in Crl.Appeal No.263 of 2017, that the petitioner shall report before the Judicial Magistgrate, Kallakurichi first working day of every month instead of report before the Learned Judicial Magistrate, Kallakurichi once in a week i.e. on every Monday at 10.30 A.M. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.B.KUMARASAMY, Advocate for the petitioner and of MR. K. MADHAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- In Crl.M.P.No.6528 of 2017 in Criminal Appeal No.263 of 2017, this Court, by Order dated 10.05.2017, has suspended the sentence and granted bail to the petitioner on certain conditions, one of which, is that the petitioner shall appear before the learned Judicial Magistrate, Kallakurichi at 10.30 a.m on every Monday until further orders.

The learned counsel for the petitioner submitted that the petitioner has been complying with the condition regularly. 3.

Heard the learned Government Advocate (Crl.Side).

In such view of the matter, the above said condition is modified to the effect that the petitioner shall appear before the learned III Additional District Sessions Court, Villupuram at Kallakurichi on the first working day of every month until the disposal of the appeal.

If the petitioner is not able to appear on any particular date, he may file a petition under Sec.317 of Criminal Procedure Code through his counsel for condoning his absence and shall appear before the trial Court on another date, in lieu of the date of his absence.

With the above modification, the petition is ordered accordingly.
