Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of declaration to declare the arbitrary cancellation of Patta No.288 by the respondents 1 to 4 without following the due procedure adumbrated under the Tamil Nadu Patta Pass Book Act, 1983 as illegal, void, arbitrary and non-est in law and consequently, direct the respondents 1 to 4 to restore the patta in respect of subject lands comprised in Old Survey Nos.166/10B New Survey No.166/10B2 situated in Thirukazhukundram village, Thirukazhukundram Taluk, Chengalpet District in favour of petitioner within the time stipulated by this Court.

O R D E R

This writ petition has been filed challenging the cancellation of patta standing in the name of private individual and unilaterally transferring the same in the name of the Government.

2. Heard Mr.Eswar, learned counsel for petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing for respondents 1 to 4.

3. Even though the petitioner has questioned the unilateral 2/4

cancellation of patta and transferring the revenue records in the name of the Government, it is seen that a representation in this regard has been given by the petitioner to the first respondent and the same is pending. It is also submitted by the learned counsel for the petitioner that an enquiry was conducted by the revenue authorities and thereafter, there was absolutely no progress. It is under these circumstances, the present writ petition has been filed before this Court.

4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the first respondent to deal with the representation made by the petitioner on 24.06.2024 on its own merits and in accordance with law after affording opportunity to the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
