O R D E R

This Criminal Original Petition has been filed praying to quash the records in Crime No.3 of 2015 on the file of the first respondent.

2. Heard the learned counsel for the petitioner; the learned Additional Public Prosecutor appearing for the first respondent and the learned counsel appearing for the second respondent.

3. On a complaint lodged by one Rajarethinam, the respondent Police have registered a case in Crime No.3 of 2015 on 19.06.2015 for the offences under Sections 417, 506 (i) I.P.C., against the petitioners herein. The allegation in the F.I.R., is that, betrothal between the first petitioner and the defacto-complainant's daughter was held on 04.06.2015, but it was called off at the instance of the accused herein. Therefore, the defacto-complainant lodged the present complaint, alleging that the accused had cheated his family. Now, it appears that the defacto-complainant and the accused have

arrived at a compromise and this petition has been filed to quash the F.I.R., 4.Today, Ms.B.Kanchana, Inspector of Police, W-14, All Women Police Station,Thiruvottiyur, Chennai-600 019 is present.

Mr.Rajarethinam, the defacto-complainant is present and he has been identified by the said Police Officer and he has also filed supporting affidavit wherein in paragraph Nos. 3,4 and 5, it has been stated as follows :

"3. I further state my family elders and the family elder of the petitioners side also settled the issue out of court. I further stated that the dispute between me and the petitioners are settled amicably out of court. I further state that the dispute between me and the petitioners are settled amicable out of court. In these circumstances, there is no any necessity to take any action against the petitioners by the first respondent police.

4. I further states that after the amicable settlement between my family and the petitioner's family, there is no any necessity for further investigation or any action against the petitioners. I have no objection to quash the FIR in Cr.No.3 of 2015 dated 19.06.2015 on the file of the respondent Police or direct the respondent police to drop the proceedings.

5. In these circumstances, it is prayed before this Hon'ble Court may be pleased to quash the FIR in Cr.No.03/2015 dated 19.6.2015 on the file of the respondent police or direct the respondent police to drop the further proceedings and pass any order may deem fit and proper and thereby render justice."

5. In view of the settlement arrived between the parties, the F.I.R., in Crime No.3 of 2015 is hereby quashed.

6. With the above observation, this Criminal Original Petition is closed.
