ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1) (aaa), 4(1-A) of TNP Act and under Section 420 IPC r/w. Sections 7 and 11 of R.S. Rules, 2000 in Crime No.04 of 2019, seeks anticipatory bail.
2. When the mater is taken up for hearing, the learned Government Advocate appearing for the respondent-Police submitted that earlier, the petitioner has moved anticipatory bail petition before this Court and the same was also dismissed. He further submitted that by suppressing the order of dismissal, now the present petition has been filed.
3. The petitioner has filed this petition suppressing the order of dismissal of this Court. The petitioner ought not to have filed the present petition without there being any subsequent development. On going through the petition filed by the petitioner, there is nothing to suggest that there is subsequent development in the investigation caused by the Investigating Agency warranting him to file the present petition. Thus, the present petition has been filed by abusing the process of Court, which cannot be permitted. Accordingly, the present Crl.O.P is dismissed, for having suppressed the factum of dismissal of earlier petition, with costs of https://hcservices.ecourts.gov.in/hcservices/
Rs.10,000/- (Rupees ten thousand only) payable to the Chief Justice's Relief Fund, High Court, Chennai, within a period of two weeks from today.
4. The Registry is directed to ensure receipt of the cost awarded by this Court is paid and if the same is not paid within the time stipulated above, necessary action shall be taken in accordance with law for recovering the said amount from the petitioner. Registry is further directed to ensure that petitions, suppressing earlier orders of dismissal are not entertained in future without proper scrutiny.
