This petition is filed under Section 378(4) Cr.P.C, to grant special leave to file an appeal against the order dated 10.02.2023 in C.C.No.101 of 2019 on the file of the learned Metropolitan Magistrate, Egmore Chennai.

2. Heard Mr. D.R. Raghunath, learned counsel for the petitioner.

3. The present petitioner filed a private complaint under Section 200 Cr.P.C against the respondent/accused for an offence punishable under Section 138 of Negotiable Instruments Act before learned Metropolitan Magistrate, Egmore Chennai, and the same was dismissed on the ground that the complainant did not pay batta under Section 204(4) r/w 256 Cr.P.C.

4. In the circumstances, there are some arguable points in the present appeal and accordingly, special leave is granted. R.HEMALATHA, J.
