ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offences under Sections 294(b), 353 of I.P.C r/w Sections 24(1) of Cigarette and other Tobacco Products Acts, 2003 in Crime No.35 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was in possession of banned tobacco products more than 25,000/- kgs. Hence the complaint.

3. The learned counsel appearing for petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate(Crl side) appearing for the respondent would submit that the petitioner was in possession of banned tobacco products more than 25,000/- kgs.. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts of the case and the quantity involved in this case is very high, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly this Criminal Original petition is dismissed with costs that the petitioner is directed to deposit a sum of Rs.15,000/- as non refundable deposit to the Chief Justice Relief Fund . -sd/- 12/05/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
