Mr.R.Govindasamy, learned Special Government Pleader takes notice for the respondents 1 to 4 & 6. Mr.G.B.Rajesh, learned Government Advocate takes notice for the fifth respondent. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. This writ petition is filed seeking for a Mandamus directing the respondents to issue patta in respect of Survey No.104, measuring an extent of 1020 sq.ft as per G.O.Ms.No.496 Revenue-cum-Disaster Management dated 24.12.2018.
3. The petitioner seeks for free house site patta. By seeking such benefit, the petitioner approached the third respondent- District Collector, Tiruvannamalai District, who in turn directed the sixth respondent-Tahsildar, Tiruvannamalai District, to consider the said request and take action and thereafter to send a report to him. Such proceedings of the third respondent is evident by a communication issued by him on 12.02.2019 to the Tahsildar, Tiruvannamalai District.
4. Therefore, it is for the third and sixth respondents to consider the claim of the petitioner and pass orders on the same on merits and in accordance with law, as this Court is not expressing any view on the merits of the claim. Thus, this Writ Petition is disposed of, only by directing the respondents 3 & 6 to consider the claim of the petitioner and pass orders on the same on merits and in accordance with law, after hearing all the parties concerned, within a period of twelve weeks from the date of receipt of a copy of this order.
