Respondent(s) PRAYER This criminal original petition is preferred under section 528 of the BNSS seeking to direct the Judicial Magistrate of Perundurai to dispose the CC.No.257/2020 in accordance with law within time as stipulated by this Hon'ble Court and pass such other further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

This caption matter has been preferred by the petitioners seeking for a direction to the learned Judicial Magistrate, Perundurai to dispose of the C.C.No.257 of 2020 as per law within the time stipulated by this Court. 2.The learned counsel for the petitioner and the learned Government Advocate (Criminal side) for the respondent are before this Court. 3.Pursuant to the order of this court dated 20.04.2026, the learned Government Advocate has produced a status report dated 17.06.2026 before this court. The relevant portion of the status report is in paragraph 10 and the same reads as follows:

'10.It is further submitted that the trial has already progressed substantially. The prosecution witnesses P.W.1 to P.W.5 were examined and their chief-examination as well as crossexamination were completed on 18.05.2026. Subsequently, on 15.06.2026, the Investigating Officer was also examined, and both chief-examination and cross-examination were completed. In the meanwhile, the accused filed 311 Cr.P.C petition for recall of PW1 & PW2 in M.P.No.16 of 2026 which was allowed and posted for 18.06.2026. Thus, almost all the material witnesses have already been examined, and only a few procedural steps remain for completion of the trial. In such circumstances, when the trial is at the verge of completion and is being proceeded with in accordance with law, the present petition is unnecessary and devoid of merits. Therefore, the petition deserves to be 2/5

dismissed as not maintainable.'

4.It is seen from the status report that P.W.1 to P.W.5 were examined and the cross examination was completed on 18.05.2026. It is also seen that pursuant to the order of this court, the learned Judicial Magistrate concerned has also sent a report, wherein it is informed that the case would be disposed of within a period of three months.

5.In the light of the submissions made and in view of the report received from the learned Judicial Magistrate, the trial court, namely the Judicial Magistrate, Perundurai is directed to complete the trial and dispose of the case in C.C.No.257 of 2020 in accordance with law, within a period of three months from the date of receipt of copy of this order without further delay.
