This matter came up for hearing today under the caption 'For Being Mentioned to' at the instance of the counsel for the petitioner.
2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for respondents 2 to 4.
3.The Writ Petition was filed challenging the order passed by the first respondent dated 05.09.2014 and the said order was passed on the Second Appeal filed before the first respondent State Information Commission. However, while disposing of the Writ Petition based on the submissions made that the impugned order was passed by the First Appellate Authority, this Court granted liberty to the petitioner to file Second Appeal before the State Information Commission. Subsequently, this was brought to the notice of this Court that the order impugned is in fact an order passed by the State Information Commission and the correctness of the same has to be decided in this Writ Petition.
4.Since the same has not been decided, the order passed in the Writ Petition dated 05.01.2015, stands recalled and the Writ Petition is restored to the file of this Court to be heard and disposed on merits.
