This petition has been filed to direct the respondent police to file final report in Crime No.152 of 2008.
2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor for the respondent and perused the materials placed on record.
3. It is represented by the learned Additional Public Prosecutor that, investigation in Crime No.152 of 2008 was completed and final report was filed on 23.12.2010 before the learned Judicial Magistrate-I, Attur. But, the final report was returned on the ground, that some of the accused in this case were released on bail and their bail papers are not available in the file of the court.
4. In the considered opinion of this Court, that cannot be a reason to return the final report. Hence, the police is directed to resubmit the final report, within two weeks from the date of receipt of a copy of this order and on such resubmission, the same shall be taken on file by the learned Judicial Magistrate-I, Attur and pass orders in accordance with law.
