Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent to consider and pass orders on the petitioner's applications dated 25.11.2014, 04.02.2016 and 26.03.2016 for grant of patta in respect of the vacant plot of land bearing Plot No.60, Kamaraj Nagar, measuring to an extent of 2635 sq.ft. comprised in Survey No.85/2, Mathur village, previously Ambattur Taluk now Madavaram Taluk, Tiruvallur District. By consent, the writ petition is taken up for final disposal.

2 The petitioner claims that he is the owner of the lands admeasuring to an extent of 2635 sq.ft., Plot No.60, Kamaraj Nagar, Mathur Village, Tiruvallur District, by means of a registered Sale Deed bearing Document No.5167/2011 dated 11.07.2011, on the file of the Sub Registrar Office, Tiruvottriyur, and claims to be in possession and enjoyment of the property right from the date of his purchase. The grievance expressed by the petitioner is that despite his representations dated 25.11.2014, 04.02.2016 and 26.03.2016 seeking patta for the said land, no orders have been passed and hence, he came forward to file the present writ petition.

3 The learned counsel for the petitioner would submit that the petitioner was orally told that since the property comes within the purview of the Tamil Nadu Urban Land Ceiling Act, the patta is not issued to him and though the said Act has been repealed, still the respondent did not choose to pass orders on the petitioner's representations for issuance of patta and therefore, the petitioner is constrained to approach this Court by filing this writ petition.

4 Heard the submissions of Mr.R.Vijayakumar, learned Additional Government Pleader who accepts notice on behalf of the respondent.

5 This Court, taking into consideration the limited scope of the prayer sought for by the petitioner and without going into the merits of the same, directs the respondent to consider and dispose of the petitioner's representations dated 04.02.2016 and 26.03.2016 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

6 The writ petition is disposed of accordingly. No costs.
