The application has been filed seeking to extend the time for further three months to complete the Arbitration Proceedings before the Arbitral Trial now presided over by the former District Judge. 2.

The status of the Arbitral Proceedings is that the respondent witness will have to be cross-examined by the claimant. Learned counsel for the petitioner herein who appears for the claimant in the Arbitral Proceedings stated that he would require one day for cross-examination. Let me be at little more indulgent and grant him 3 separate days for completing cross-examination. Thereafter, both the learned counsels would have to advance arguments. Even if they were to argue the entire day by each one of them, they should be in a position to complete the arguments in two working days. But again let me be little indulgent and grant both of them 10 days for commencing and completing arguments. By any mathematical calculation, the Arbitral Tribunal should be able to complete the proceedings on or before 31.05.2024. https://www.mhc.tn.gov.in/judis

Both the learned counsels however stated that further time should be granted and uniformly stated, one through physical presence and other through Video Conference, that the time may be extended till 30.06.2024.
