Respondents * * * Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus, or any other appropriate Writ, order or direction more in the nature of a writ directing the first respondent to consider the representation of the petitioner dated 29.06.2012, and pass appropriate orders, by issuing permission to the petitioner for quarrying at the site, viz., at Alapuram Village, Pappireddipatti Taluk (then Harur Taluk), Dharmapuri District, comprised in S.No.446 measuring an extent of 30.63 Acres for a period of 6 years, 3 months and 13 days from the date of commencement of quarrying activities by the petitioner without causing any hindrance to the petitioner in effectual implementation of the decree granted in O.S.No.38 of 2005 dated 11.01.2008 - Sub Court, Dharmapuri, by according permission to remove and transport the granite blocks by issuing permits, gate pass etc.

ORDER

1. After some arguments, the learned counsel for the petitioner seeks to withdraw the captioned writ petition, in view of the fact that a decree, dated 11.01.2008, in O.S.No.38 of 2005 on the file of the Sub Court, Dharmapuri, has been obtained.

1.1. Learned counsel also makes an endorsement to that effect, on the case bundle.

2. Accordingly, the writ petition is dismissed as withdrawn. Needless to say that the petitioner will be free to take recourse to an appreciate remedy in accordance with law.
