ORDER

This Criminal Original Petition has been filed seeking to quash the private complaint in C.C. No. 343 of 2018 on the file of Judicial Magistrate, Fast Track Court, Alandur.

2. Heard both sides.

3. The petitioner is arrayed as accused in the complaint in C.C.No.343 of 2018 filed under Sec.200 of Cr.P.C. by the respondent for an offence punishable under Sec.138 r/w Sec. 142 of Negotiable Instruments Act. Now, the petitioner had filed this petition praying to quash the said complaint.

4. Today, when the matter taken up for hearing, the learned counsel for respondent would submit that already trial was begun and evidence was completed and the case is posted for counter and disposal. Hence, he prayed to dismiss this petition. To that effect, he has filed e-court status. The learned counsel for petitioner has also accepted the said fact. Page No.2 of 4

On considering their submissions stating that already the trial was begun, evidence was completed and now the case is riped for counter and disposal in C.C.No. 343 of 2018 on the file of Judicial Magistrate, Fast Track Court, Alandur, this Criminal Original Petition is closed. However, liberty is granted to the petitioner to work out his remedy and putforth all his defence before the trial court. Consequently, connected Criminal Miscellaneous Petition is closed.
