ORDER

The petitioner who was arrested on 28.08.2020 and remanded to judicial custody for the offences punishable under Sections 20(b)(ii) (C) of NDPS Act r/w Section 8(C) of NDPS Act 1985 and Section 77 of JJ Act, 2015 in Cr.No.247 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused persons were found in illegal possession of 76 kilos and 284 grams of Ganja. Hence, the complaint was registered.

3. The learned counsel for the petitioner submitted that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and the petitioner has been in jail from 28.08.2020 Therefore, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) would submit that the investigation has been completed and charge sheet has also been filed in Spl.S.C.No.55 of 2020 before the learned Special Judge for NDPS Cases, Puducherry. He would further submit that there is one https://hcservices.ecourts.gov.in/hcservices/

previous case pending against the petitioner and A5 is yet to be secured. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Having regard to the nature of allegations and considering the fact that A5 is yet to be secured, this Court is not inclined to grant bail to the petitioner.
