The present application has been filed seeking the respondent /Judgment Debtor to appear before this Court and disclose on affidavit the details and particulars of the Fixed Assets, Current Assets and Bank accounts held in their name.

In response to the notice that had been served upon the respondent in the application, an affidavit had been filed on behalf of the respondent, in which the Executive Engineer of the respondent on an affidavit had disclosed an asset, which related to an immovable property at Nagapattinam Port Complex, which had been valued by them at Rs.3,16,86,000/- which according to them would satisfy the award amount. The same was objected to by the learned counsel for the applicant indicating that the same is not a full disclosure as sought for by the applicant. He would have also further submitted that the same is not in the proper form as required under the law.

In view that the respondent had filed the affidavit, I see no impediment in ordering the application as prayed for.
