& O.P.No.816 of 2019 P.T.ASHA, J., The above application is filed for terminating the mandate of the Arbitrator appointed by orders of this Court dated 29.01.2020 in O.P.No.816 of 2019 on the ground that the Arbitrator does not satisfy the eligibility criteria for appointment under the provisions of Arbitration and Conciliation Act, 1996 read with Madras High Court Arbitration and Proceedings Rules, 2017.

The 1st respondent / petitioner had filed a counter but however the learned counsels had agreed to the appointment of Mr.Yashod Vardhan, Senior Counsel, No.21(8), VII Main Road, Raja Annamalaipuram, Chennai 600 028, Mob:98410 75397, as the sole Arbitrator. He shall adjudicate upon the arbitral 1/3

proceedings that has arisen between the parties and pass an award. The proceedings shall be conducted under the aegis of the Madras High Court Arbitration Centre, Chennai - 600 104, in accordance with the Madras High Court Arbitration Proceedings Rules, 2017 and the Madras High Court Arbitration Centre (MHCAC) (Administrative Cost and Arbitrator's Fees) Rules, 2017.

3. The application is allowed and the order dated 29.01.2020 therefore stands modified to the above extent. 14.10.2020 kan 2/3
