O R D E R

This petition has been filed to direct the respondent to complete the process of serving summons to the 2nd and 3rd accused and to expedite the trial in CC.No.263 of 2013 on the file of the learned Judicial Magistrate No.1, Mannargudi.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.

3. It is seen that though the Final Report in CC.No.263 of 2013 was filed on 12.03.2013 before the learned Judicial Magistrate-I, Mannargudi, yet summons have not been served on some of the accused till date. The last docket order of the Trial Court dated 22.07.2015 reads as follows:

"Accused is present and other accused are absent. Issue fresh summon by 17.08.2015."

4. Learned Additional Public Prosecutor submits that the Final Report has been filed against two accused namely Krishnamoorthy-A1 and Vignesh-A2 and that Vignesh has been shown as a juvenile. https://hcservices.ecourts.gov.in/hcservices/

5. However, it is not known as to how the docket order shows that A2 is absent. Under such circumstances, the Trial Court is directed to bestow its attention to these aspects and proceed with the trial expeditiously.
