Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the notional promotion to the petitioner as Forest Guard on par with juniors by including the name in the panel drawn for the year 2003-2004 with effect from 31.05.2004 for purpose of getting enhanced pension (Petitioner service was regularised on par with junior's only now) and in the light of order passed by this Court in W.P. No.15726 of 2016 dated 28.04.2016 by considering the representation dated 03.04.2024 and 05.12.2024 and order in W.P. No.1229 of 2024 dated 23.01.2024 in time limit to stipulated by this Court.

ORDER

This Writ Petition has been filed in the nature of a mandamus seeking examination of the representation given by the petitioner on 05.12.2024.

2. In the affidavit filed in support of the writ petition, it had been stated by the petitioner that he had been originally appointed as plot watcher on daily wage basis in the Forest Department. Thereafter, the statewide seniority list was also prepared and the services of the petitioner was regularised in the cadre of Forest Watcher. It had been stated that the services had been so regularised in the year 2012. He had filed a writ petition even earlier and a direction was issued to consider grant of notionally regularisation in the cadre of forest watcher on par with juniors with effect from 24.01.1995. In this connection, as aforementioned, the writ petitioner had also given representation.

3. It is only appropriate that the respondents examine the representation and if the petitioner is otherwise eligible, on perusal of the Service Record, grant notional regularisation/promotion on and from the date on which the services were brought into regular service and on par with the juniors.

4. This Writ Petition stands disposed of. No costs.
