PRAYER :- To enlarge the Petitioners/Accused 1 to 3 on bail pending investigation in Crime No.154 of 2021 on the file of the Respondent Police.

ORDER

The petitioners, who were arrested on 14.03.2021 for the offences punishable under Sections 394 & 397 of IPC in Crime No.154 of 2021, on the file of the respondent police, seek bail.

2. The case of the prosecution is that on 12.03.2021 at midnight, the petitioners said to have attacked the defacto complainant's husband who was coming in a cycle and snatched the cell phone. Due to the said incident, the victim suffered serious head injury and he is in coma stage and still taking treatment.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and falsely implicated in this case and they are in judicial custody from 14.03.2021 and seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent strongly opposes this petition and submits that the victim suffered serious head injury and now in coma stage. He also submits that on the same day, eight other similar cases were registered against the petitioners.

5. It is seen from the earlier order passed by the learned Principal Sessions Judge, Chennai in Crl.M.P.No.5574 of 2021 dated 15.04.2021 that the victim sustained laceration on linear fronto parietal measuring 12 x 1.5 x 1 cm, depressed skull at occipital region and spine was immobilized. No doubt, serious injuries were suffered by the victim and he is in coma stage and taking treatment till now.

6. Considering the facts and circumstances of the case, the serious injuries suffered by the victim and the fact that eight other cases were registered against the petitioners on the very same day, this Court is not inclined to grant bail to the petitioners. Accordingly, this petition is dismissed.
