Criminal Original Petition filed under Section 482 of Cr.P.C., seeking direction to the respondent police to conduct further investigation and include all the offence committed by the accused stated in the complaint dated 20.04.2019 by considering petitioner's representation dated 03.07.2019 in Crime No.358 of 2019.

ORDER

This criminal original petition has been filed seeking direction to the respondent police to conduct further investigation and include all the offences committed by the accused stated in the complaint dated 20.04.2019 by considering the petitioner's representation dated 03.07.2019 in Crime No.358 of 2019.

2.It is seen from the FIR in Crime No.358 of 2019 that it was registered on the basis of the complaint given by one Jayaprathap and a case has been registered under Section 409 & 420 IPC against Arunkumar and 7 others, alleging that through online fund transfer scheme, they cheated several persons, especially, the defacto complainant, namely Jayaprathap, to the tune of Rs.7,80,000/-.

3.Now, it is alleged by the petitioner that the petitioner is also one of the person defrauded by the accused in that case. He stated that he has already given a complaint and the learned Judicial Magistrate had directed to take into consideration the complaint given by the petitioner and investigate along with the FIR already registered in this case.

4.It appears that the accused in Crime No.358 of 2019 had cheated not only the defacto complainant in that case, but the petitioner in this case also. Therefore, the respondent police is directed to take into consideration the representation made by the petitioner on 03.07.2019 and file a final report in Crime No.358 of 2019.
