C.M.P. No.23490 of 2023 in S.A.No.1179 of 2011 N.SENTHILKUMAR, J This Civil Miscellaneous Petition is filed to restore the Second Appeal in S.A.No.1179 of 2011 which was dismissed for non-prosecution by the order of this Court dated 10.03.2023.

Notice was effected on the contesting respondents. Despite notice being served on the respondents, none appeared on their behalf.

It is seen from the records that the 3rd respondent is no more and legal heirs of 3rd respondent are the respondents 5 to 8 who are already on record and service has also been effected on them.

Being satisfied with the reasons stated in the affidavit filed in support of the above petition, the Civil Miscellaneous Petition is allowed.

Registry is directed to restore the Second Appeal to file and list the same for hearing on 27.09.2024.
