The learned counsel for the appellant reported no instructions.

The learned counsel for the second respondent filed an affidavit indicating that the first respondent issued orders pursuant to the contract and the company has supplied the goods as per the purchase order. According to the second respondent, in view of the subsequent events nothing survives for adjudication.

3. The intra court appeal is dismissed as infructuous taking into account the affidavit filed by the second respondent. No costs. Consequently, connected miscellaneous petition is closed.
