Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents herein to pay the family pension to the petitioner with all arrears, on account of death of her husband C.Muniappa formerly Revenue Supervisor in the office of the Junior Engineer (O&M), Thally, Krishnagiri District and to disburse such benefits to her together with interest at 12% p.a.

ORDER

The petitioner is stated to be the second wife of Thiru.C.Muniappa, who worked as Revenue Supervisor in Tamil Nadu Electricity Board. According to the petitioner, the first wife of Thiru.C.Muniappa died and thereafter only she was given in marriage to him. In the said marriage, the petitioner got one child born on 08.04.2000. Thiru.C.Muniappa retired from service on 30.06.2008. He was receiving pension till his death on 24.07.2011. The petitioner thereafter submitted a representation for family pension besides arrears. The representation was given on 11.08.2014. However, there was no follow up action taken by the respondents resulting in filing this writ petition.

2.The fourth respondent is directed to consider and dispose of the representation submitted by the petitioner dated 11.08.2014 on merits and in accordance with law. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

3.The writ petition is disposed of with the above direction. No costs.
