C.M.P. No.11978 of 2022 in C.R.P.(PD).No.4222 of 2015 J.NISHA BANU,J.

This petition has been filed to condone the delay of 16 days to restore the above C.R.P. which was dismissed for default on 14.03.2022.

2. The civil revision petition was dismissed for default on the ground that the C.R.P. is of the year 2015 and at the time of admission, notice was ordered to the respondents on 20.10.2015 and interim stay has been granted for a period of one week and that thereafter, on 23.09.2016, fresh notice was ordered on the respondents and interim order was extended till 18.10.2016 and again on 14.03.2017, the learned counsel for the petitioner undertook to pay second batta in respect of the second respondent on or before 15.03.2017 and on payment of batta, the Registry was directed to issue notice to the second respondent and the interim stay was ordered to be continued and that even though several opportunities have been given to the petitioner, service of notice to the respondents has not been completed by the petitioner.

On perusal of the order dated 14.03.2022, it is seen that though sufficient opportunity was given to the petitioner for taking steps to proceed with the case, the petitioner was not diligent enough to prosecute the case and thus, the Civil Revision Petition was dismissed for non-prosecution. https://www.mhc.tn.gov.in/judis

vsi -2Therefore, this Court is not inclined to entertain this petition. Hence, this civil miscellaneous petition is dismissed.
