This petition has been filed to enlarge the petitioner on bail pending trail in C.C No. 1038 of 2023 on the file of Principal Special Judge, for NDPS Act, Chennai.

2. The case of the prosecution is that the A1 who was a auto driver was allegedly apprehended with 15 grams of cocaine and based on his confession the respondent police found the petitioner with the possession of 195 grams of Cocaine. Hence,the case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case based on the confession statement of A1. Further, the petitioner is ready to abide any condition as impose by this court. On the other side, the learned Government Advocate (Crl. side ) submitted that the A1 who was a auto driver was allegedly apprehended with 15 grams of cocaine and based on his confession the respondent police found the petitioner with the possession of 195 grams of Cocaine. Further, he stated that the petitioner has not engaged the

counsel before the Trial Court.

4. Considering the fact that 192 grams of Cocaine was seized from the petitioner which is commercial quantity and also he has not engaged the counsel before the Trial Court. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this petition is dismissed. 16.04.2024 pbl
