Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the 5th and 6th respondents to conduct investigation upon the frequent power tariff hike by the 2nd respondent and consequently direct the 7th respondent to conduct periodic audit for the past years in the 2nd respondent Corporation and file the status report before this Court within the stipulated period as may be fixed by this Court. O R D E R
(Made by The Hon'ble The Chief Justice) We are not inclined to entertain this public interest litigation, as it is devoid of all particulars of material in support thereof. The prayer made is for conduct of investigation upon frequent power tariff hike and periodic audits. The petitioner cannot act as an Auditor of these authorities.
2. Learned counsel for the petitioner sought to plead that there are power thefts taking place and the efforts in reduction of power thefts have not been substantive. On a query, there is nothing on record to show any material in this behalf.
3. We, thus, dismiss the writ petition.
4. At this stage, learned counsel for the petitioner states that he may be permitted to withdraw the petition, so that he may collect other materials and prefer a petition, setting out the statute or the rules, which have been violated, supported by facts gathered in that behalf.
5. The writ petition is dismissed as withdrawn, with the aforesaid liberty. No costs. Consequently, M.P. No.1 of 2014 is also dismissed.
