Writ Petition filed under Article 226 of the Constitution of India to issue a writ of certiorarified mandamus calling for the records of the respondents in relation to the proceedings issued in No.P11/11129581/1/R1129581 dated 15.02.2023 and in No.P11/2/11129921/ADK/34 dated 17.04.2023 by the sixth respondent and quash the same and issue a consequential direction to the sixth respondent to approve the Selection Grade Scale of Pay of petitioner of Rs.15600-39100 + 5400 GP in the post of Vocational Instructor with notional benefit from 01.01.2006 and with monetary benefit from 01.04.2013 as ordered in G.O.Ms.No.306, Finance (CMPC) Department, dated 12.09.2018 and allow the petitioner to draw same pay in the post of P.G. Assistant and fix last pay drawn and grant all consequential monetary benefits including arrears of pay, pension and pensionary benefits.

ORDER

This writ petition is being filed for the following relief: "to call for the records of the respondents in relation to the proceedings issued in No.P11/11129581/1/R1129581 dated 15.02.2023 and in No.P11/2/11129921/ADK/34 dated 17.04.2023 by the sixth respondent and quash the same and

issue a consequential direction to the sixth respondent to approve the Selection Grade Scale of Pay of petitioner of Rs.15600-39100 + 5400 GP in the post of Vocational Instructor with notional benefit from 01.01.2006 and with monetary benefit from 01.04.2013 as ordered in G.O.Ms.No.306, Finance (CMPC) Department, dated 12.09.2018 and allow the petitioner to draw same pay in the post of P.G. Assistant and fix last pay drawn and grant all consequential monetary benefits including arrears of pay, pension and pensionary benefits."

Earlier, this Court, in the similar facts and circumstances, in W.P.No.11879 of 2023, has granted the following relief to the petitioner therein:

"8. In such a view of the matter, this writ petition is disposed of, directing the respondents to continue to pay the selection grade pay/special grade pay to the petitioner, subject to the condition that petitioner complies with all the other requirements.

No costs.

Consequently, connected Miscellaneous Petitions are closed."

Taking the same into consideration, this Court is inclined to grant the same benefit to the petitioner herein also, since the facts and circumstances of this case is similar to that of the case referred above.

Accordingly, this writ petition stands disposed of, directing the respondents to continue to pay the selection grade pay/special grade pay to the petitioner, subject to the condition that the petitioner complies with all the other requirements.
