Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, to direct the respondents 1 to 4 to consider the representation dated 13.02.2024 and take necessary action against the unauthorized construction activities of the respondent No.5, including, but not limited to, issuing appropriate orders for the demolition and removal of the unauthorized construction, and to ensure the smooth conduct of the temple festival and associated rituals in accordance with the rights and traditions of the villagers and the Temple.

O R D E R
[Made by S.M.SUBRAMANIAM, J.,] With reference to the relief sought for in the present writ petition, the learned Additional Government Pleader, based on written instructions from the Tahsildar, Thenkanikottai, would submit that survey conducted, encroachers were identified and enforcement actions commenced. A notice under Section 7 of 'the Tamil Nadu Land Encroachment Act, 1905 (Tamil Nadu Act III of 1905)' {hereinafter '1905 Act' for the sake of brevity} was Page Nos.2/4
issued to the encroachers and after affording opportunity, a final notice under Section 6 of the 1905 Act was issued.
2. The learned counsel for the contesting respondents would submit that an appeal under Section 10 of the 1905 Act was filed before the District Collector.
3. The District Collector is empowered to grant interim order under Section 10-B of the 1905 Act. In the absence of any interim order, there is no impediment for the authorities to proceed with the enforcement actions in the manner known to law.
4. In view of the fact that the procedure as contemplated under 1905 Act has been followed, the official respondents are directed to conclude the same as expeditiously as possible.
5. With the above direction, the Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
