C.M.P.No.8960 of 2023 in C.M.A.SR.No.49188 of 2023 N.MALA,J, This petition is filed to condone the delay of 311 days in filing the above C.M.A.SR.No.49188 of 2023.

2. Notice to the 1st respondent is dispensed with vide EB.

3. Mr.K.Vinod, learned counsel appears for the 2nd respondent and he fairly submits that he has no objection to the delay of 311 days being condoned, subject to the condition that the petitioners/claimants shall not be entitled to interest for the delay period of 311 days.

4. In view of the above submission made by the learned counsel for the 2nd respondent, the delay of 311 days is condoned and the petition is accordingly ordered, on condition that the petitioners shall forfeit the interest for the delay period of 311 days.
