PRAYER: Criminal Original Petition filed under Section 528 of BNSS, to direct the second and third respondent police not to harass the petitioners and also direct them to issue proper summons to petitioners for enquiry and pass such further or any other order may deem fit proper in the circumstances of the case and thus render justice.

ORDER
This Criminal Original Petition has been filed seeking a direction to the second and third respondent police not to harass the petitioners and to issue proper summons to the petitioners for enquiry.
2. The case of the prosecution is that the petitioners have been running a nursery school in the name of Kabali Nursery & Primary School, since the year 1990, rendering educational services to the needy and poor with a good reputation. However, the second respondent police received a complaint alleging money laundering from one Rajesh Kanna. Pursuant to which, the respondent police issued a summon to the first petitioner for personal enquiry. The first petitioner has attended the enquiry on the said date and was further instructed to appear on next day for further enquiry.
3. The learned counsel for the petitioners submitted that there is a dispute
with regard to the payment of loan and repayment accounts. Further, he submitted that the dispute is purely civil in nature, but has been projected as a criminal case, and that the petitioners have been harassed by the 3rd respondent.

Mr.Leonard Arul Joseph Selvam, learned Additional Public Prosecutor appearing for the respondents, on instructions, submitted that based on the complaint given by one Rajesh Kanna, an enquiry was conducted and the petitioners were called for enquiry. During the course of enquiry, it was found that the issue involved in the present case is purely civil in nature. Accordingly, the respondents have closed the enquiry, directing the petitioners and the counter petitioner to approach the competent Civil Court, and submitted that the respondents are not harassing the petitioners.
5. In view of the above submission made by the learned Additional Public Prosecutor for the respondents, this Criminal Original is dismissed, with liberty to the petitioners to approach the competent Civil Court to work out their remedy in the manner known to law.
