Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking issuance of writ of mandamus, directing the Respondents to consider the petitioner's representation dated 26.02.2024 for providing water pipeline for agriculture and drinking purpose and further direct the Respondents to provide culvert or construct a Bridge to have free access through the National Highway to reach Achandiram vilalge, Hosur Taluk, Krishnagiri District within the time to be stipulated by this Honourable Court.

ORDER

This Writ Petition has been filed for a direction to the Respondents to consider the petitioner's representation dated 26.02.2024

The learned counsel for the petitioner would submit that the petitioner made a representation dated 26.02.2024 for providing water pipeline for agriculture and drinking purpose and also to provide culvert or construct a Bridge to have free access through the National Highway to reach Achandiram village, Hosur Taluk, Krishnagiri District. Since no order has been passed, the present writ petition is filed.

3. The learned counsel appearing for the 5th respondent would submit that it is not feasible to provide access to the petitioner's land through the National Highways, since the speed limit in the National Highway is 125 Kilometres per hour.

4. Heard the learned counsel for the petitioner as well as the respondents.

5. Though the petitioner made a representation dated 26.02.2024, the 5th respondent filed a counter affidavit stating that it is not feasible to provide any access for laying the water pipeline as the speed limit fixed in National Highway is 120 Kilometres per hour. Therefore, this Court is not inclined to go into all those aspects, however, directs the 5th respondent Authority to pass appropriate orders on the representation of the petitioner dated 26.02.2024, highlighting all those aspects, after affording opportunity to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order. If the petitioner is aggrieved by the order, he can very well challenge the same before the appropriate forum, in the manner known to law.
