C.M.P.No.10038 of 2023 in C.M.A.SR.No.49217 of 2023 N.MALA,J, This petition is filed to condone the delay of 1374 days in filing the above C.M.A.SR.No.49217 of 2023.

2. Notice to the 1st respondent is dispensed with vide Batta SR 18053.

3. Though the 2nd respondent was served with notice, none appears before this Court.

4. I have gone through the affidavit filed in support of this petition and I am of the view that the delay of 1374 days can be condoned on condition that the petitioner shall forfeit the interest for the delay period of 1374 days and this petition is accordingly ordered.
