Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent herein to consider and pass orders on the petition dated 12.12.2018 seeking legal heir certificate for the deceased Ellammal.

Mr.B.Anandan, learned Government Advocate takes notice for the respondent. By consent of the parties the main writ petition is taken up for final disposal at the admission stage itself.

2. The petitioners seek for a Mandamus, directing the respondent herein to consider and pass orders on the petition dated 12.12.2018 seeking legal heir certificate for the deceased Ellammal.

3. The grievance of the petitioners is that even though they made a petition on 12.12.2018, seeking for issuance of legal heirship certificate of the deceased viz., Ellammal, who died on 28.04.2016, the respondent has not considered the said petition so far.

4. Heard both sides.

5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioners, as it is for the respondent to consider and decide the same on merits and in accordance with law. Accordingly, this writ petition is disposed of, only by directing the respondent to consider the request of the petitioners and pass orders on the same on merits and in accordance with law, after hearing the petitioners and after conducting proper enquiry. Such exercise shall be done by the respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
