ORDER
The petitioners apprehends arrest for the alleged offence under Sections 21(1) of Mines and Minerals (Development and Regulation) Act 1957 r/w under sections 303(2) of BNS Act, 2023 in Crime No.35 of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the petitioners were found to be transporting 4 units of pebble stones illegally. Hence, the case.
3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case. The petitioners are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are two cases pending against the A2/1st petitioner and nine cases pending against the A3/ 2nd petitioner. Hence, he opposed to grant anticipatory bail to the petitioners.

From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the very factum that the petitioner have criminal antecedents and it discloses that they misused the liberty granted by this Court. This Court is of a firm view that these petitioners does not deserve anticipatory bail. Hence, this Criminal Original Petition is dismissed. 26-03-2026 SHL To:
