Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to grant her promotion to the post of Executive Officer Selection Grade with effect from 2001-2002 as per the Seniority list published by the respondent on 12.07.2013 with all attendant and consequential benefits including revised pension and other Terminal benefits with all arrears.

ORDER

The petitioner joined service as Junior Assistant on 04.04.1972. She was promoted as Head Clerk/Executive Officer Grade - II on 10.09.1985. She was further promoted as Executive Officer Grade I. She retired from service on 31.05.2006 while she was serving as Executive Officer Grade I.

2. According to the petitioner, in the revised seniority list of Executive Officer Selection Grade, the name of the petitioner finds place at Serial No.85, for the year 2005-2006.

3. If the petitioner was granted promotion based on the said seniority list, she could have retired as Executive Officer Selection Grade. She made a representation dated 11.12.2014 to the second respondent in this regard.

4. Learned counsel for the petitioner has brought to my notice an order passed by the second respondent in an identical https://hcservices.ecourts.gov.in/hcservices/

circumstances giving notional promotion to a person.

5. In these circumstances, the Writ Petition is disposed of, directing the second respondent to pass orders on the representation of the petitioner dated 11.12.2014, in the light of the proceedings in Na.Ka.No.6793/2013/A7, of the second respondent dated 04.02.2015, and on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
