O R D E R

This Writ Petition has been filed to direct the respondents 1 and 2 to offer police protection to the petitioner's life and limbs and to his meat shop premises by name "Mariye Vazhga A1 Fresh Meat Stall at No.94/31, Fathima Puram, Arunthathi Puram, Kelachari Village, Thiruvallur Taluk & District.

2. Heard the learned counsel on either side.

The learned counsel for the petitioner submitted that the petitioner seeks police protection to his life and to his shop on the ground that the third respondent is disturbing and interfering in doing his business in the subject property. He further submitted that the petitioner is the owner of the subject property and had obtained an order of interim injunction in his favour in I.A.No.3 of 2022 in O.S.No.100 of 2022 on the file of the District Munsif Court, Thiruvallur as against the defendants. Despite the same, the third respondent herein is interfering in running his business and hence, the petitioner

seeks police protection. Hence, he prayed this Court to grant the relief sought for by the petitioner in the present Writ Petition.

4. Per contra, the learned Additional Public Prosecutor on instructions, submitted that the subject property is the government land and patta was wrongly obtained by the petitioner which was also cancelled.

5. Considered the rival submissions made by the respective learned counsels and also perused the materials available on record.

6. On perusal of the records, it is seen that the footpath of the subject property leads to the graveyard of the village. It is brought to the notice of this Court that the suit filed by the petitioner herein was also dismissed.

7. Considering the facts and circumstance of the case, this Court is of the opinion that without establishing the title of the subject property, the relief sought for by the petitioner cannot be granted. The petitioner is directed to approach the Civil Court to seek declaration of title.

8. For the reasons stated above, the Writ Petition stands dismissed. There shall be no orders as to costs.
