The writ petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus directing the respondents to issue patta in the name of the petitioner for the house property to an extent of 2600 sq. ft. comprised in S.No.64/1 in Old Door No.3/1, New Door No.380/7 in Pandaravedu Village, Pallipet Taluk, Thiruvallur District pursuant to the petitioner's representation dated 28.09.2021. ORDER

The Writ Petition has been filed seeking direction to the respondents to issue patta in the name of the petitioner for the house property to an extent of 2600 sq. ft. comprised in S.No.64/1 in Old Door No.3/1, New Door No.380/7 in Pandaravedu Village, Pallipet Taluk, Thiruvallur District pursuant to the petitioner's representation dated 28.09.2021.

The case of the petitioner is that he is the owner of the house to an extent of 2600 Sq. ft. comprised in S.No.64/1 in Old Door No.3/1 New Door No.380/7 in Pandaravedu Village, Pallipat Taluk, Thiruvallur District which is the share of the petitioner by way of an oral partition between the petitioner and his

brother in the year 1981. The petitioner is the continuous possession and enjoyment of the property. While being so, on 27.06.2019, 16.03.2020, 03.03.2021 and 28.09.2021, the petitioner made a representation to the Tahsildar to issue patta in his name for the above said property. Since the same was not considered, the present writ petition has been filed before this Court seeking with the afore said prayer.

3. The learned counsel for the petitioner submitted that this Court may issue a direction to the respondents to consider the petitioner's several representations and to grant patta in favour of the petitioner within the time limit as fixed by this Court.

4. The learned Additional Government Pleader fairly submitted that the representation will be considered and necessary orders will be passed in accordance with law within the time frame as fixed by this Court.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case and the submission made on either side, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 28.09.2021 after providing opportunity to the necessary parties, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

7. With the above directions, these writ petitions are disposed of. No costs.
