ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the fourth respondent to consider the representation of the petitioner dated 30.10.2023 to cancel the patta issued in favour of the fifth respondent.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 4 and perused the materials available on record.

4. The case of the petitioner is that the subject property has been purchased by the husband of the petitioner by way of registered a sale deed dated 22.12.2008 and they are in possession of the property since the date of purchase. While so, the fifth respondent has obtained patta unlawfully for the said land from the fourth respondent. In this regard the petitioner has given a representation to respondents 1 to 4 on 30.10.2023 to cancel the patta issued in 2/5

favour of the fifth respondent. But no action has been taken by the respondents in this regard. Hence, the present Writ Petition.

Considering the limited relief sought for in this writ petition, there shall be a direction to the respondents 1 to 4 to consider the representation of the petitioner dated 30.10.2023 and pass Orders on the same on its own merits and in accordance with law, after giving opportunity to the fifth respondent also, within a period of two months from the date of receipt of a copy of this order.
